These Terms of Use are governed by the laws of Canada without regard to its conflict of law principles.
9. Cancellation Policy
At Tutor Advance, we value our clients' time and commitment, as well as our tutors’ availability. To ensure fairness and efficiency in scheduling, we have established the following cancellation policy:
i. Client Cancellations

Clients must provide at least 24 hours' notice if they wish to cancel or reschedule a session. Failure to do so will result in the full session fee being charged.

If the cancellation is due to an illness, the client must provide at least 3 hours' notice to avoid being charged. This policy helps maintain accountability and prevents last-minute no-shows.

Cancellations made within 24 hours due to an emergency (as defined below) will not incur any charges.
ii. Tutor Cancellations

The tutor will provide at least 48 hours' notice for any cancellations.

If the tutor cancels within 48 hours, the same rules outlined in the client cancellation policy will apply.

If the tutor cancels due to an emergency, they will notify the client as soon as possible and arrange a rescheduled session at no extra cost.
iii. Definition of an Emergency
An emergency is defined as an unforeseen and unavoidable circumstance that makes attending the session impossible. Acceptable emergencies include:

Death of an immediate family member (parent, sibling, child, spouse, or grandparent).

Severe illness or hospitalization (e.g., serious flu requiring hospitalization, broken bones, or any condition requiring urgent medical attention).

Physical harm due to an accident (e.g., car accident, workplace injury).

Power or internet outages affecting the ability to conduct the session (evidence may be required for verification).

Extreme weather events that make online access impossible (e.g., widespread power outages due to storms).

Natural disasters or crisis situations that disrupt normal life (e.g., earthquakes, floods, fires).
Minor inconveniences, such as general fatigue, mild colds, or scheduling conflicts that could have been foreseen, do not qualify as emergencies and will not exempt a client from cancellation charges.
iv. No-Shows
A client who fails to attend a session without prior notice will be charged the full session fee. If this occurs more than once, the tutor reserves the right to discontinue tutoring services.
v. Rescheduling Policy
Rescheduling is permitted under the same conditions as cancellations. Requests must be made with at least 24 hours' notice, or the session fee will apply unless due to an emergency.
